Terms of Service (B2B)

These Terms govern the use of snaptosuit by companies and organizations. As of: 2026-06-19. By registering you accept these Terms.

1. Scope

These Terms apply exclusively to the use of snaptosuit by companies, legal entities and organizations (B2B). Consumers within the meaning of Art. 32a Swiss CO are excluded. Deviating terms of the customer apply only if expressly agreed in writing by snaptosuit.

2. Conclusion of contract

The contract is concluded upon registration of an account and confirmation by snaptosuit. Contracting parties are the organization stated in the registration and snaptosuit. The registering person warrants authority to represent the organization.

3. Service

snaptosuit is a software-as-a-service that generates professional portraits from uploaded selfies using artificial intelligence (OpenAI gpt-image-2). The service is provided "as is". There is NO entitlement to specific image quality, specific response time, specific results or avoidance of AI-typical artifacts. We reserve the right to adapt or discontinue the service and its features at any time.

4. Prices, credits and payment

Prices result from the plan displayed in the dashboard. Subscriptions are billed monthly in advance. A generation consumes one credit. Remaining subscription credits expire at the end of the respective billing period. Top-up credits do not expire. No refunds are issued for consumed credits, paid subscription periods or upon account suspension. Payments are processed via Stripe. In case of payment default, snaptosuit may suspend access immediately.

5. Price adjustments

snaptosuit may adjust prices at any time with 30 days' notice. Existing customers will be informed by email. If the customer rejects the change, they may cancel within the notice period; otherwise the change is deemed accepted.

6. Customer obligations and warranties

The customer warrants and guarantees: (a) they hold all required rights and explicit consents of the persons depicted in uploaded images, including consent to AI processing and transfer to the USA; (b) uploaded content does not infringe any third-party rights (copyright, personality rights, trademarks); (c) they do not use the service for unlawful purposes, deception, deepfakes without consent, pornography, harassment or to create images of minors. Violations entitle snaptosuit to immediate suspension without refund.

7. Indemnification

The customer indemnifies snaptosuit, its staff and processors against all third-party claims (including legal fees and damages) arising from a violation of Section 6 or from the customer's use of the generated images.

8. Image rights

The customer retains all rights to their uploaded original images. snaptosuit grants the customer a non-exclusive, worldwide, perpetual right of use for commercial and private use of the generated portraits, to the extent permitted by applicable law. snaptosuit reserves a non-exclusive right to use anonymized aggregates to improve the service.

9. Limitation of liability

snaptosuit is liable only for intent and gross negligence. Liability for slight negligence is excluded to the maximum extent permitted by law. snaptosuit's total liability to the customer per incident is limited to the fees paid in the 12 months prior to the incident. Excluded in particular is liability for lost profits, indirect damages, data loss and reputation damage. Liability for third parties (in particular OpenAI) is excluded.

10. Availability

snaptosuit aims for high availability but does not provide a guaranteed availability (SLA). Maintenance windows, outages of service providers (OpenAI, Stripe, cloud providers) and force majeure exclude any liability.

11. Term and termination

Subscriptions run monthly and renew automatically unless cancelled before the end of the current period. Cancellation is done via the Stripe portal or the dashboard. snaptosuit may terminate the contract with 30 days' notice or immediately for cause (in particular violation of Section 6).

12. Changes to these Terms

snaptosuit may modify these Terms with 30 days' notice via email. Without a written objection within the notice period, the modified Terms are deemed accepted.

13. Assignment

snaptosuit may assign rights and obligations under this contract to third parties at any time (e.g. in case of corporate succession). Assignment by the customer requires snaptosuit's prior written consent.

14. Data protection

The processing of personal data is governed by the separate Privacy Policy, which forms an integral part of these Terms.

15. Miscellaneous

Should individual provisions be invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a regulation that comes closest to the economic purpose of the invalid provision. Exclusively Swiss law applies, excluding the UN Convention on the International Sale of Goods. Exclusive place of jurisdiction is Zürich, Schweiz.
